With the rapid development of artificial intelligence and other emerging technologies in recent years, data innovation and utilization have become vital issues for enhancing national competitiveness.
I. Background and Core Pillars of the Draft Act
Based on a comprehensive consideration of international legal trends regarding data innovation and utilization and current domestic practices in Taiwan, the Ministry has drafted the "Data Innovation and Utilization Development Act (Draft)" with the following key points:
- Core Pillars: Focusing on the systematic and institutionalized promotion of data openness, sharing, and reuse.
- Privacy and Trust: Promoting data circulation while simultaneously balancing personal privacy protection and strengthening social trust.
- Data Ecosystem: Laying the foundation for national digital development and technological innovation by expanding government data opening and sharing, encouraging industrial data sharing, and guiding private sector data altruism.
- Expected Benefits: Striking a balance between promoting data circulation and safeguarding rights, thereby strengthening government governance efficiency, promoting industrial innovation, and enhancing national competitiveness.
II. Implementation Progress
The phased implementation schedule for this draft is as follows:
- 2025/06/16 – 08/15: Public notice of the draft to solicit opinions from all sectors.
- 2026/03: Submitted to the Executive Yuan for review.
